Initiation of Bilateral Safeguard duty imposed on the imports of PVC Suspension Resin (PVC) originating in or exported from Japan (08.09.2020)

Product description – PVC Suspension Resin or Poly Vinyl Chloride Suspension Resin is a homopolymer of vinyl chloride monomer (suspension grade), in which various polymer chains are not linked to each other. The product however under consideration excludes PVC suspension resins such as cross-linked PVC, chlorinated PVC (CPVC), vinyl chloride – vinyl acetate copolymer (VC-VAc), PVC paste resin and PVC blending resin.

HS Codes – The HS code prescribed under the Customs Tariff Act, 1975 is 39041020.

Uses – PVC is commonly used in manufacturing of various products like pipes and fittings, flexible hoses, films/sheets, bottles, profiles, wire and cables, footwears, etc.

Countries involved –The present investigation being a Bilateral Safeguard Investigation has been initiated against Japan.

Applicants – Chemplast Cuddalore Vinyls Limited, DCW Limited and DCM Shriram Limited

Period of investigation – The period of investigation (POI) for the present investigation is 2016-17, 2017-18, 2018-19 and 2019-20.

Other investigations involving the product – The subject goods have had several trade remedy investigation in India in past. Directorate General of Trade Remedies had recommended anti-dumping duties against the imports of the subject goods from China PR, Indonesia, Japan, Korea RP, Malaysia, Taiwan, Thailand and United States of America in investigation in 2006. Thereafter, in a separate investigation anti-dumping duties were also imposed against the imports from European Union and Mexico. However, at present anti-dumping duties are only imposed on imports from China PR and United States of America.

Facts of the present case – The Authority has found prima facie evidence that imports of product under consideration have increased significantly due to concessions under CEPA agreement which has caused serious injury to the domestic industry.
