Initiation of Sunset review investigation into imports of Ceramic Tableware and Kitchenware, excluding Knives and Toilet items from China PR (31.08.2021)

HS Code – 6911 and 6912

Uses – Ceramic tableware and kitchenware are used for the purpose of eating, drinking, and serving food and beverages in homes and hotels.

Countries involved – China PR

Applicant – Clay Craft (I) Private Limited and Ceramic Tableware Private Limited.

Period of investigation – 1st April 2020 to 31st March 2021

Injury period – 2017-18, 2018-19, 2019-20 and the Period of investigation.

Past investigations involving the product – Provisional anti-dumping duties were first levied vide Notification No. 27/2017-Cus (ADD), dated 12.06.2017 and final duties were first levied vide Notification No. 04/2018-Customs (ADD), dated 21st February 2018. The recommendation of the Authority for extension of existing Anti-dumping duty on subject goods from Malaysia is pending for consideration with the Ministry of Finance. The current anti-dumping duties, if not extended, will expire on 20th February 2023.

Facts of the present case – Despite duties in force, the imports from the subject countries have remained significant in absolute and relative terms. The dumped imports are undercutting the prices of the domestic industry. Further, persistent imports and circumvention practices of the Chinese producers, intensified dumping, trade remedial measures imposed by other jurisdictions, and vulnerability of the domestic industry due to price sensitive market demonstrate that the dumping and injury are likely to continue in the event of expiry of duty.
