Initiation of anti-dumping duty investigation concerning imports of “Caprolactam” originating in or exported from European Union, Korea RP, Russia and Thailand (30.09.2020)

Applicant – Gujarat State Fertilizers and Chemicals Limited

Period of investigation – April 2019 to March 2020

Injury period – 2016-17, 2017-18, 2018-19 and period of investigation.

Past investigations involving the product – Anti dumping investigation was initiated in 2003 on the imports of Japan, European Union, Nigeria and Thailand. Duties were recommended in September 2004 and imposed in November 2004.

Facts of the present case – Authority has found prima facie evidence regarding injury having taken place as a result of the alleged dumping, resulting in increased volume of dumped imports in absolute terms and in relation to production and consumption in India. The Authority also found that performance of the applicant has been adversely impacted in respect of production, sales, capacity utilization, market share, and losses are being suffered by the domestic industry with negative return on capital employed during the period of investigation (POI), as a result of increase in imports of product under consideration at a price below non-injurious price.
