Initiation of sunset review investigation of anti-dumping on imports of “Fluoroelastomer” originating in or exported from China PR (16.06.2025)

Product Description – The product under consideration is Fluoroelastomers (FKM). FKM is a class of synthetic rubber designed for very high temperature operation. It is broadly categorized in two sets – Copolymer and Terpolymer and can be classified by their fluorine content, 66%, 68% and 70% respectively.

HS Codes – The product is classified under Chapter 39 of the Customs Tariff Act under the subheading 3904 and is imported under various codes such as 39045090, 39046990, 39049000 and 39046910.

Uses –  FKM has various applications such as industrial use in hydraulic 0-ring seals, check valve balls, electrical connectors, automotive use in shaft seals, fuel injector 0-rings, and aerospace use in 0-ring seals in fuels, lubricants & hydraulic system, manifold gaskets and fuel tank bladders.

Facts of the Present Case – The present application was filed by Gujarat Fluorochemicals Limited, which is the sole producer of FKM in India. This is a second sunset review, and the present duties are in force till 27th November 2025. The applicant submitted that in spite of the present duty, the volume of imports from the subject country has increased over the injury period in absolute as we as relative terms. That applicant also provided information on capacity expansion, decline in demand in the subject country and measures imposed by third countries to show that there is likelihood of continuation of dumping from the subject country and the consequent injury to the domestic industry in case of cessation of the ani-dumping duties.
