Facts of the present case: The present review application was filed by Indorama Yarns Private Limited, IVL Dhunseri Petrochem Industries Private Limited, and Reliance Industries Limited seeking redressal against likelihood of continuation and recurrence of dumping and injury from subject imports, in case of cessation of anti-dumping duty. The applicants have claimed that the condition of the domestic industry remains fragile even when the duties are in force and that cessation of duty is likely to create price pressure and impact profitability of the domestic industry. It has been noted that the subject imports have increased over the injury period and have entered at prices below selling price and cost of sales of the domestic industry. Further, the applicants have further provided information that China is subject to trade remedial measures in other jurisdictions and there exists significant exportable capacities in the subject country with India acting as a price attractive market. The Authority therefore found sufficient evidence of likelihood of continuation or recurrence of dumping and consequent injury to the domestic industry in the event of cessation of anti-dumping duty.
