Key Findings –

  1. SRF Limited and Gujarat Fluorochemicals Limited constitute “domestic industry”.
  2. The product produced by the domestic industry is a like article to the product under consideration imported from the subject country.
  3. Normal value for China PR has been determined under Para 7 of Annexure I to the Rules on the basis of the price payable in India, having regard to the optimised cost of production in India, duly adjusted for reasonable administrative, selling and general costs and profits.
  4. Dumping margin is above de minimis level and significant.
  5. Imports from the subject country have increased in absolute and relative terms.
  6. Price undercutting is positive and significant during the period of investigation.
  7. Prices of the domestic industry have been depressed in the period of investigation.
  8. Improvement in production, capacity utilisation, domestic sales and market share of the domestic industry during the period of investigation is not commensurate with the growth in demand or with the capacity available with the domestic industry and its ability to cater to the domestic market.
  9. The profitability parameters and return on capital employed of the domestic industry have declined steeply in the period of investigation.
  10. The other known factors examined in the non-attribution analysis have not caused injury to the domestic industry.
  11. There exists a causal link between the dumped imports from the subject country and the material injury so suffered.
  12. Injury margin is positive and significant.
  13. Imposition of anti-dumping duty is not against the wider public interest.
  14. Impact of anti-dumping duty on downstream products is negligible.
  15. Domestic industry has sufficient capacity to cater entire demand in India after meeting its captive requirement. Additionally, another producer, Navin Fluorine International Limited, has commenced production post POI.
