Facts of the present case: The present application for anti-circumvention investigation was filed by Swati Petro Products Ltd. and Blue Jet Healthcare Ltd. The applicants have submitted that the existing countervailing duty levied on Saccharin originating in or exported from China PR vide Notification No. 01/2025-Customs (CVD) dated 25th February 2025, is being circumvented through imports from Thailand. There has been significant change in the pattern of trade following the imposition of countervailing duties on China PR and cessation of anti-circumvention duties on Thailand. The imports from Thailand commenced only after imposition countervailable duty on China PR in August 2019, increased thereafter, and declined post imposition of anti-circumvention duties on Thailand, and have intensified again after cessation of duties on Thailand. The Saccharin exported from Thailand is not produced there but is of Chinese origin, merely routed through Thailand. The identified exporter in Thailand is a trader rather than a producer as the country lacks genuine manufacturing facilities. The import price from Thailand is lower than that from China PR and undercuts domestic selling prices, with undercutting intensifying in the POI. Imports from Thailand have increased in volume and market share, capturing a significant share of domestic demand. The applicants have requested retrospective imposition of countervailing duty on the circumventing imports from Thailand. The Authority, having been prima facie satisfied by the information provided, initiated the investigation vide Notification No. 7/01/2026-DGTR dated 10th March 2026.
