Initiation of anti-dumping investigation concerning import of “Vacuum Insulated Flask or Vessels of Stainless Steel” originating in or exported from China PR (20.09.2023)

Product description – The product under consideration is Vacuum Insulated Flask or Vessels of Stainless Steel, such as flasks, cups, bottles, kettle, carafe, and dispenser. The body of the flask is made up of two walls with a vacuum between them which acts as an insulator or non-conductor of heat thereby helping maintain the temperature of the liquid.

HS Codes – The product is classified under chapter 96 of the Customs Tariff Act,1975 and imported under Heading 96170011 and 96170012. The custom classification is only indicative and the same is not binding.

Uses – Vacuum Flasks are used to maintain the temperature of liquids for a considerable amount of time.

Countries Involved – China PR

Applicants – Placero International Private Limited, also referred to as “Pexpo”.

Period of investigation – Applicant had proposed period of investigation as 1st January 2022 to 31st December 2022. However, on being directed by the Authority the period has been modified to April 2022-March 2023. Therefore, application is based on the data/information for the period from April 2022 to March 2023 (12 months).

Injury period – 2019-20, 2020-21, 2021-22 and the period of investigation.

Facts of present case – The present application was filed pursuant to significant increase in dumping of Vacuum flasks and vessels from China PR, especially in the POI and resultant injury to the domestic industry. The evidence submitted by the domestic industry shows the injury to domestic industry on account of price undercutting and price supressing, profitability, return on investment, capacity utilisation, and accumulation of inventories. The evidence shows prima facie evidence of causal link between dumping from China PR and injury suffered by domestic industry.
